thirdly,imentionedinmypreviousreplythatisuspectedtheeffectivenessofsuchclaimbecausesuchsmallclaimscouldbeeasilythrewoutbyajudgebeforethehearing.anditturnedoutiwasrightaboutitaftericonfirmedwithafriendwhohasexperienceswithsmallclaimcourt.therearedoctrinesoflaweveninsmallclaimscourtsthatlimitthissortofstrategy.courtsoftenhaveconsiderableleewayinthrowingoutclaims,thoughobviouslyoftennotbeforebothsidesareheard.butgiventhatsmallclaimscourtstypicallydonothavelawyersandthattherearesuchsmallbarrierstofilingasuit,iwouldnotbesurprisediftherearecertainstrategiescourtscouldapplytothrowoutcasesevenwithouttheothersidehavingtoappearorfilearesponse.forexample,thecourtcouldsuasponte(ofitsowninitiative)examineclaimsfordamagesorevenmorelikely,jurisdiction.everycourthastohavewhatiscalledpersonaljurisdictionoverthelitigants,andtherewouldbeanargumentastowhetherthecourthadjurisdictionoverthe

smallclaimagainsttimewarner.evenifthecourtiswronginitsanalysis,itwouldbeaconvenientwayforittothrowoutabunchofcases.othersimilarargumentsthatthecourtcomeupwithasifitweretimewarnerincludecausation/responsibility,thattheyareresponsibleforhiscommentsontheair,etc.
